Two years ago, the Journal of Law, Medicine & Ethics published volume 28, number 4, devoted to a symposium entitled Human Subjects Research and the Role of Institutional Review Boards - Conflicts and Challenges. I had the good fortune to be asked to serve as editor of that issue. In her introduction to the symposium, the then editor-in-chief of the journal, Ellen Wright Clayton, observed that the country is currently undergoing a major reexamination of how biomedical research is conducted. While (...) that reexamination has continued in the interim, some very recent events raise questions about the extent to which this will continue, at least in the short run, with equal vigor. The intervening years have witnessed a variety of new directions and events. The federal Office of Human Research Protections, directed by Dr. Greg Koski, who wrote a brief commentary for the last symposium,L has taken a new direction, strongly stressing the need for institutions and their institutional review boards ORBS) to engage in extensive educational and quality improvement efforts with both researchers and their own member. The Ethics and Regulation of Research with Human Subjects, edited by Professors Carl Coleman of Seton Hall, Jerry Menikoff of the University of Kansas, Jesse Goldner of Saint Louis University, and Nancy Dubler of the Albert Einstein College of Medicine, is an up-to-date and authoritative collection of readings on ethical, legal, and policy issues in research with human subjects. The authors have modeled their text on the casebook style commonly used in law schools. At 746 pages, plus front (...) matter and an appendix, this book contains just about everything one needs to know for a thorough grasp on human subjects research, including federal and state regulations governing this research, interpretive guidance from federal agencies, international guidelines and codes, court decisions, historical documents and case studies, and selected readings from scholarly articles and books. As mariculture—the cultivation of aquatic organisms in marine environment—intensifies to meet the demands of sustainable blue growth and national policies, novel ethical challenges will arise. In the context of ethics, primary concerns over aquaculture and mariculture tend to stay within differing value-based perspectives focused on benefits to human and non-human subjects, specifically animal welfare and animal rights. Nonetheless, the burgeoning field of feminist blue humanities provides ethical considerations that extend beyond animal subjects (including humans), often because of its concerns with (...) new materialist, posthumanist, and other relations-based theories. This article examines feminist blue humanities and the contributions it may bring to understanding contemporary and future ethical challenges posed by mariculture and its intensification, especially the cultivation of low-trophic organisms. By offering an overview of feminist blue humanities, this article explores some of its particularities by drawing out three major ethical concerns facing contemporary mariculture, specifically material reconfigurations, radical alteration of the lives of low-trophic species through industrialization and increases in maricultural waste products. The Emotional Construction of Morals is a book about moral judgements – the kinds of mental states we might express by sentences such as, ‘It's bad to flash your neighbors’, or ‘You ought not eat your pets’. There are three basic questions that get addressed: what are the psychological states that constitute such judgements? What kinds of properties do such judgements refer to? And, where do these judgements come from? The first question concerns moral psychology, the second metaethics and the (...) third is best construed as belonging to a domain that has been neglected in analytic value theory: the genealogy of morals. These are all separate branches of ethics, but they are interconnected. The thesis of the book is that moral judgements are emotional attitudes that refer to response-dependent properties, and that these responses have been shaped by cultural history. I call the view Constructive Sentimentalism. The first half of the book deals with sentiments, and the second half with construction. The second half also deals with relativism, because I argue that moral values are constructed differently across cultures and across individuals.Thus described, The Emotional Construction of Morals is a conventional contribution to analytic moral philosophy, taking on some of the core questions in that field and defending positions that have a long philosophical pedigree. Indeed, the theory I defend has roots in Hume and Nietzsche, though it departs from both in various ways. What makes the book somewhat unusual is that it seeks to defend traditional theories by appeal to recent work in psychology, neuroscience, anthropology and related fields. It is an exercise in methodological naturalism and committed to the view that we can answer traditional philosophical questions while treating ethics as a social science. This article is a cry for help. It is a search for some possible view of legal philosophy that does not render it either intrinsically useless or useless in its current form. In this article I focus on two methodological hallmarks of contemporary anglophone legal philosophy. The first is the Archimedean way in which the legal theorist places a critical distance between him- or herself and the subject matter of the philosophical inquiry. The second is the introverted way in which (...) the accuracy of any given legal theory is confined to the theorist’s own puzzles, concerns, controversies, and preoccupations. Whilst I consider those who have turned against these methodological commitments and called for an anti-Archimedean or extroverted approach to legal theory, I explain how those who accept both commitments adopt a very modest view of the helpfulness of legal philosophy. I then consider whether, contrary to the modest view, if we accept both commitments, then whatever is true in legal philosophy will always be trivially true, irrelevant, or inconsequential, for any non-philosophical practice or non-philosophical inquiry about the law. The value of this article, I hope, lies in its refutation. (shrink)

Jesse Prinz argues that recent work in philosophy, neuroscience, and anthropology supports two radical hypotheses about the nature of morality: moral values are based on emotional responses, and these emotional responses are inculcated by culture, not hard-wired through natural selection. In the first half of the book, Jesse Prinz defends the hypothesis that morality has an emotional foundation. Evidence from brain imaging, social psychology, and psychopathology suggest that, when we judge something to be right or wrong, we are (...) merely expressing our emotions. Prinz argues that these emotions do not track objective features of reality; rather, the rightness and wrongness of an act consists in the fact that people are disposed to have certain emotions towards it. In the second half of the book, he turns to a defense of moral relativism. Moral facts depend on emotional responses, and emotional responses vary from culture to culture. Prinz surveys the anthropological record to establish moral variation, and he draws on cultural history to show how attitudes toward practices such as cannibalism and marriage change over time. He also criticizes evidence from animal behavior and child development that has been taken to support the claim that moral attitudes are hard-wired by natural selection. Prinz concludes that there is no single true morality, but he also argues that some moral values are better than others; moral progress is possible. Throughout the book, Prinz relates his views to contemporary and historical work in philosophical ethics. His views echo themes in the writings of David Hume and Friedrich Nietzsche, but Prinz supports, extends, and revises these classic theories using the resources of cutting-edge cognitive science. The Emotional Construction of Morals will stimulate and challenge anyone who is curious about the nature and origin of moral values. (shrink)

Burnout has important ramifications for employees and organizations and preventing burnout forms an ethical issue for managers. However, the role of the leader and especially the role of ethical aspects of leadership have received relatively little attention in relation to burnout to date. We conducted a survey among employees (N = 386) of a Dutch retail organization, nested in 122 teams with a leader. Our first contribution is that we empirically show the hypothesized opposing relationships of ethical and passive leadership (...) behavior with follower burnout. Furthermore, we examined two job characteristics as mechanisms that link these forms of leadership and burnout. Lastly, we show that the positive relationship of ethical leadership with burnout via role clarity (but not overload) is dependent on the degree of passive leadership the leader is perceived to display. Our results suggest that organizations should promote ethical leadership behaviors and limit passive leadership behaviors by stimulating leaders to be active in their role and use their social influence to promote ethical conduct. Gut Reactions is an interdisciplinary defense of the claim that emotions are perceptions of changes in the body.

Psychologism is defined as “the doctrine that the laws of mathematics and logic can be reduced to or depend on the laws governing thinking” (Moran & Cohen, 2012 266). And for Husserl, the laws of logic include the laws of meaning: “logic evidently is the science of meanings as such [Wissenschaft von Bedeutungen als solchen]” (Husserl ( 1975 ) 98/2001 225). I argue that, since it is sufficient for a theory to be psychologistic if the empiricistic theory of abstraction is (...) employed, it follows that neural networks are psychologistic insofar as they use this theory of abstraction, which I demonstrate is the case (Husserl ( 1975 ) 191/2001 120). It’s sufficient for psychologism because, according to Husserl, the theory in question reduces one’s phenomenological ability to intend types (or universals) to one’s past history of intending tokens (or particulars), usually amalgamated in some fashion (classically via associations; recently via autoencoders) (ibid; Kelleher, 2019 ). Similarly dynamical systems theory entails psychologism. For dynamical systems theory ties content to the temporal evolution of a system, which, according to Husserl, violates the fact that intentionality toward validities and objectivities does not pertain to "particular temporal experience[s]" (Husserl ( 1975 ) 194/2001 121). It follows that neither the species (neural networks), nor the genus (dynamical systems), can avoid psychologism and intend objects "in specie" (ibid). After critiquing these two approaches, I proceed to give an account based on the essentialist school of cognitive psychology of how we may intend objects "in specie" while avoiding the empiricistic theory of abstraction (Keil, 1989, Carey, 2009, Marcus & Davis, 2019 ). Such an account preserves the type-token distinction without psychologistic reduction to the temporal evolution of a dynamical system (Hinzen, 2006 ). This opens the way toward a truly unifying account of Husserlian phenomenology in league with cognitive science that avoids Yoshimi's ( 2016 ) and neurophenomenology's psychologistic foundation (herein demonstrated) and builds upon Sokolowski's ( 2003 ) syntactic account of Husserlian phenomenology. The present article examines how people’s belief in an afterlife, as well as closely related supernatural beliefs, may open an empirical backdoor to our understanding of the evolution of human social cognition. Recent findings and logic from the cognitive sciences contribute to a novel theory of existential psychology, one that is grounded in the tenets of Darwinian natural selection. Many of the predominant questions of existential psychology strike at the heart of cognitive science. They involve: causal attribution (why is mortal (...) behavior represented as being causally related to one’s afterlife? how are dead agents envisaged as communicating messages to the living?), moral judgment (why are certain social behaviors, i.e., transgressions, believed to have ultimate repercussions after death or to reap the punishment of disgruntled ancestors?), theory of mind (how can we know what it is “like” to be dead? what social-cognitive strategies do people use to reason about the minds of the dead?), concept acquisition (how does a common-sense dualism interact with a formalized socio-religious indoctrination in childhood? how are supernatural properties of the dead conceptualized by young minds?), and teleological reasoning (why do people so often see their lives as being designed for a purpose that must be accomplished before they perish? how do various life events affect people’s interpretation of this purpose?), among others. The central thesis of the present article is that an organized cognitive “system” dedicated to forming illusory representations of (1) psychological immortality, (2) the intelligent design of the self, and (3) the symbolic meaning of natural events evolved in response to the unique selective pressures of the human social environment. The moral domain is broader than the empathy and justice concerns assessed by existing measures of moral competence, and it is not just a subset of the values assessed by value inventories. To fill the need for reliable and theoretically grounded measurement of the full range of moral concerns, we developed the Moral Foundations Questionnaire on the basis of a theoretical model of 5 universally available sets of moral intuitions: Harm/Care, Fairness/Reciprocity, Ingroup/Loyalty, Authority/Respect, and Purity/Sanctity. We present evidence for the (...) internal and external validity of the scale and the model, and in doing so we present new findings about morality: Comparative model fitting of confirmatory factor analyses provides empirical justification for a 5-factor structure of moral concerns; convergent/discriminant validity evidence suggests that moral concerns predict personality features and social group attitudes not previously considered morally relevant; and we establish pragmatic validity of the measure in providing new knowledge and research opportunities concerning demographic and cultural differences in moral intuitions. These analyses provide evidence for the usefulness of Moral Foundations Theory in simultaneously increasing the scope and sharpening the resolution of psychological views of morality. (shrink)

Hubert Dreyfus once noted that it would be difficult to ascertain whether Edmund Husserl had a computational theory of mind. I provide evidence that he had one. Both Steven Pinker and Steven Horst think that the computational theory of mind must have two components: a representational-symbolic component and a causal component. Bearing this in mind, we proceed to a close-reading of the sections of “On the Logic of Signs” wherein Husserl presents, if I’m correct, his computational theory of mind embedded (...) in a language of thought. My argument goes like this: the computational theory of mind is the idea, following Haugeland, that the mind comes prepackaged as, or is endogenously constrained to be, an automatic formal system; this explains, according to Husserl, why automatic trains of thought without logical intent resemble arguments exhibiting deductive structure with logical intent. In general, an automatic formal system yields true results provided that the syntactic symbols with which they compute are univocal and are semantically evaluable, and the mechanized inferences they perform are valid and preserve truth. These two conditions describe a computational cognitive process: the first condition connects representations to syntax, and the second condition uses the syntax, in inauthentic judging, to arrive at true conclusions through blind causality. Now, in point of textual fact, these are the conditions which Husserl attributes to our “natural psychological mechanism of symbolic inference” which typically yields true results. Since a formal system attributed to the “internal structure” of the mind, and guided by blind causality, just is the computational theory of mind, it follows, I think, that Husserl had a computational theory of mind. This computational theory is, moreover, embedded in a language of thought, since Husserl attributes a language-like form to our thoughts so that they may be mechanically processed. The representations of deep convolutional neural networks (CNNs) are formed from generalizing similarities and abstracting from differences in the manner of the empiricist theory of abstraction (Buckner, Synthese 195:5339–5372, 2018). The empiricist theory of abstraction is well understood to entail infinite regress and circularity in content constitution (Husserl, Logical Investigations. Routledge, 2001). This paper argues these entailments hold a fortiori for deep CNNs. Two theses result: deep CNNs require supplementation by Quine’s “apparatus of identity and quantification” in order to (1) (...) achieve concepts, and (2) represent objects, as opposed to “half-entities” corresponding to similarity amalgams (Quine, Quintessence, Cambridge, 2004, p. 107). Similarity amalgams are also called “approximate meaning[s]” (Marcus & Davis, Rebooting AI, Pantheon, 2019, p. 132). Although Husserl inferred the “complete abandonment of the empiricist theory of abstraction” (a fortiori deep CNNs) due to the infinite regress and circularity arguments examined in this paper, I argue that the statistical learning of deep CNNs may be incorporated into a Fodorian hybrid account that supports Quine’s “sortal predicates, negation, plurals, identity, pronouns, and quantifiers” which are representationally necessary to overcome the regress/circularity in content constitution and achieve objective (as opposed to similarity-subjective) representation (Burge, Origins of Objectivity. Oxford, 2010, p. 238). I base myself initially on Yoshimi’s (New Frontiers in Psychology, 2011) attempt to explain Husserlian phenomenology with neural networks but depart from him due to the arguments and consequently propose a two-system view which converges with Weiskopf’s proposal (“Observational Concepts.” The Conceptual Mind.
